By diverting the case away from the federal courts and toward the state supreme court, the 9th Circuit has almost certainly delayed a substantive ruling on the merits of the case for at least a year and likely longer.

So the SCOTUS will NOT get its hands on Prop 8 before November 2012.

There is a very strong chance that Prop 8 will be repealed via ballot vote in November 2012.

and even if Prop 8 survives a ballot challenge………..

proponents still need to prove they have STANDING to appeal the case.
by the looks of things; they don’t have standing!

The Supreme Court will likely dodge the case on the grounds of that defendants lack standing to appeal.
So we may never know how Anthony Kennedy would rule on this case.
